Terminology

For purposes of this agreement (the 'Agreement'), the Platform is referred to as 'we', 'us', or 'our'. Users and other visitors to the Platform are referred to as 'you', 'your', or 'User'. Collectively, 'we' and 'you' are referred to as 'both parties' and individually as 'a/one party'.

Processing and Retention Periods for Personal Information

We will process and retain your personal data for as long as required by law or for the period agreed when we collected it from you.

As a rule, we retain your personal data for 1.5 years after you delete your account or if it is deactivated for misuse. This Agreement applies to all Users who trade on the Brío Fundalis Global website and its mobile app (the "Platform"). Users must adhere to the terms and conditions set forth in this Agreement and comply with all applicable laws and regulations regarding personal information and data protection in their respective country or region.

Invocation

Any reference in this Agreement to codes, statutory decrees, or administrative regulations shall be deemed to refer to the latest amended version, whether the amendment occurred before or after the Agreement was executed.

In this Agreement, 'include' always means 'including but not limited to' unless stated otherwise.

For example, we may use video (including audio) recordings to verify the identity of P2P merchants and as evidence in P2P order disputes. Additionally, facial video (including audio) data may be used for Brío Fundalis identity verification on third-party platforms..

Limitation of Liability

Although the Platform implements technical and security safeguards to protect your information, we cannot guarantee that data transmitted over the internet is 100% secure. Accordingly, we make no warranties regarding the security of the personal information you provide and cannot be held responsible for any loss or damage resulting from unauthorized access to your personal data.

Updates to this Agreement

We reserve the right to modify this Agreement at any time. If we update the Privacy Policy, we will notify you by posting the revised version, including the new effective date and a summary of the changes. By continuing to use the Platform after changes take effect, you agree to the updated terms.
